FLORIDA FEDERAL JUDGE RULES ‘ENTIRE’ HEALTH CARE LAW UNCONSTITUTIONAL

A federal judge in Florida has ruled that the president’s health care overhaul, “Obamacare,” is unconstitutional.

The judge based his ruling on the law’s mandate that citizens must purchase health care, a requirement he said violates the Constitution. The ruling affects the 26 states who had joined together to file a case against the law, yet still has implications for the entire country.

U.S. District Judge Roger Vinson ruled Congress overstepped its bounds by instituting the individual mandate, but also said the entire law was unconstitutional since the individual mandate is not “severable,” Fox News reports. Vinson did not go as far as to issue an injunction blocking the law from being implemented.

“I must reluctantly conclude that Congress exceeded the bounds of its authority in passing the Act with the individual mandate. That is not to say, of course, that Congress is without power to address the problems and inequities in our health care system. The health care market is more than one sixth of the national economy, and without doubt Congress has the power to reform and
regulate this market. That has not been disputed in this case. The principal dispute has been about how Congress chose to exercise that power here,” Vinson wrote in the 78-page ruling.

“Because the individual mandate is unconstitutional and not severable, the entire act must be declared void,” he added.

“The individual mandate applies across the board. People have no choice and there is no way to avoid it. Those who fall under the individual mandate either comply with it, or they are penalized. It is not based on an activity that they make the choice to undertake. Rather, it is based solely on citizenship and on being alive,” he wrote.

House Speaker John Boehner (R-OH) responded on Monday via a written statement.

“Today’s decision affirms the view, held by most of the states and a majority of the American people, that the federal government should not be in the business of forcing you to buy health insurance and punishing you if you don’t,” he said.

Last month, a federal judge in Virginia also ruled that the individual insurance mandate of the Obamacare was unconstitutional. That judge, however, did not go as far as to say the entire law was unconstitutional.

The ruling is just one more example of why the law is unpopular, and why it faces an uphill battle before being fully implemented in 2014. For example, just last week the House of Representatives repealed the law. Still, despite the ruling in Virginia and the House’s actions, the president doubled-down on his support of the bill last week, defiantly brushing aside those who question the overhaul.

“You may have heard once or twice this is a job-crushing, granny-threatening, budget-busting monstrosity,” Obama said. “That just doesn’t match up to the reality.”

“I can report that Granny is safe,” he quipped.

The Florida case is likely to go to the U.S. Supreme Court, especially considering this is the fourth federal ruling on the president’s health care overhaul. Besides the Virginia decision, two other federal judges have ruled in favor of the insurance mandate.

If you would like to know what the White House really thinks of Obamacare, there’s an easy way. Look past its press releases. Ignore its promises. Forget its talking points. Instead, simply witness for yourself the outrageous way the White House protects its best friends from Obamacare.

Last year, we learned that the Department of Health and Human Services(HHS) had granted 111 waivers to protect a lucky few from the onerous regulations of the new national health care overhaul. That number quickly and quietly climbed to 222, and last week we learned that the number of Obamacare privileged escapes has skyrocketed to 733.

Among the fortunate is a who’s who list of unions, businesses and even several cities and four states (Massachusetts, New Jersey, Ohio and Tennessee) but none of the friends of Barack feature as prominently as the Service Employees International Union (SEIU).

How can you get your own free pass from Obamacare? Maybe you can just donate $27 million to President Obama‘s campaign efforts. That’s what Andy Stern did as president of SEIU in 2008. He has been the most frequent guest at Mr. Obama‘s White House.

Backroom deals have become par for the course for proponents of Obamacare. Senators were greased with special favors, like Nebraska Democratic Sen. Ben Nelson and his Cornhusker Kickback and Louisiana Democrat Sen. Mary L. Landrieu and her Louisiana Purchase. Even the American Medical Association was brought in line under threat of losing its exclusive and lucrative medical coding contracts with the government.

Not only are the payoffs an affront to our democracy and an outright assault on our taxpayers, the timing itself of the latest release makes a mockery of this administration’s transparency promises. More than 500 of the 733 waivers, we now know, were granted in December but kept conveniently under wraps until the day after the president’s State of the Union address. HHS is no stranger to covering up bad news; in fact, this is becoming a disturbing pattern. Last year, Secretary Kathleen Sebelius hid from Congress until after the Obamacare vote a damning report from the Medicare and Medicaid Office of the Actuary showing Obamacare would cost $311 billion more than promised and would displace 14 million Americans from their current insurance.

For this administration, transparency promises last only until the teleprompter is unplugged.

Backroom deals and cover-ups may be business as usual for Washington, but understanding why the Obama administration protects its friends from Obamacare offers special insight into what the purveyors of the mandate themselves think about their own law. This is key: The waivers aren’t meant to protect victims from unintended consequences of Obamacare; they are meant to exempt them from the very intentional increased costs of health insurance that the law causes. Under Section 2711 of the Public Health Service Act, Obamacare increases the annual cap of insurance benefits, which sounds great - as does everything else in big government - until the bill comes due, in this case, in the form of higher insurance premiums.

In short, the administration has decided that you will face increased health insurance premiums, but special friends in the unions will not. Look closely, and you’ll see not only the White House‘s duplicity but also what the Obama administration really thinks of its crown jewel, Obamacare. White House words say that the annual insurance benefit cap is a feature of the program, but its actions say that it’s a bug.

The question remains: If Obamacare is such a great law, why does the White House keep protecting its best friends from it?

Our democracy cannot allow a president to exercise the unholy power of picking and choosing winners and losers, of choosing who must follow his flawed laws and who gets a free pass. If any American deserves a waiver from Obamacare, then all Americans do.

It was Mr. Obama himself who infamously said, "We're gonna punish our enemies and we're gonna reward our friends." This president speaks anything but softly, and Obamacare is his big stick.

It's time to give every American his own waiver: Repeal Obamacare.

WILL FRANKEN-MOSQUITOS THREATEN THE FOOD CHAIN?

An experiment meant to curb the rise of Dengue fever is raising many questions after it was announced that 6000 genetically altered mosquitos were released into a Malaysian forrest.

Dengue fever is certainly a scourge. And while infections have recently been on the rise, it is not normally a fatal disease. According to the WHO, most people recover from dengue without any complications. Since mosquitos transmit dengue, it was normal to look for ways to control their population and limit the chances for transmission. In the past, governments have limited their management of the mosquito problem to reducing breeding areas, this is one of the first efforts known to introduce modified mosquitos that will produce fewer offspring into the ecosystem.

So we have fewer mosquitos on the planet, what could possibly go wrong?  After all, the Cayman Islands also did a little experiment with modified mosquitos last year and they reported an 80% reduction in the little blood suckers.  Again, what could possibly be bad about a planet with fewer mosquitos?

Let’s see. . . mosquitos feed on us, but who needs mosquitos to live?   Birds, dragonflies, frogs, bats, and something called the mosquito fish.   Ok, so we might have a few less birds, dragonflies, frogs, bats, and mosquito fish.  Some say it is small price to pay for getting rid of those pesky vampires.  Can’t we live without those a few birds, frogs and fish?

Hmmm, aside from people, what eats frogs, birds and fish?   Snakes, mongoose, many species of cats enjoy frogs and birds.   Once you step back and look at the big picture here, the dominos all line up pretty quickly.  And once they start falling, it may be too late

Am I being an alarmist?  It’s only a few mosquitos. . . and the government said that a month after the “test” they went in with insecticide and killed all of the modified bugs.  Unless I see 6000 tiny body bags, each filled with a genetically modified mosquito, I’m not buying it.

Food-borne bacteria can fatally hit heartU.S. researchers report they have isolated a strain of food-borne bacteria from the heart of a patient with endocarditis.

Researchers at the University of Illinois at Chicago College of Medicine found 90 percent of mice with the "cardiac strain" of the food-borne bacteria listeria monocytogenes developed endocarditis -- an inflammation of the inner layer of the heart, the endocardium.

Mice with the cardiac strain had 10 times as much bacteria in the heart than mice infected with other strains of the bacteria.

The study, published online in the Journal of Medical Microbiology, indicated a search for more strains of the bacteria yielded 10 and, of these, one caused endocarditis.

"Usually with endocarditis there is bacterial growth on heart valves, but in this case the infection had invaded the cardiac muscle," chief investigator Nancy Freitag said in a statement.

Freitag suggested cardiac-associated strains have surface proteins that may enable the bacteria to more easily enter heart cells.

Freitag noted the bacteria, which can grow in refrigerated foods, is quite common but infections are usually mild.

"As foods are being produced with a longer and longer shelf life, listeria infection may become more common," Freitag said. "In combination with an aging population that is more susceptible to serious infection, it's important that we learn all we can about these deadly infections."

These vaccines help protect the biggest killers of children younger than 5, including pneumonia, diphtheria, whooping cough, tetanus, hepatitis B and Haemophilus influenzae type B, which causes meningitis.

The remaining $34 million will be directed to the World Health Organization and UNICEF to deliver polio vaccines in Afghanistan and Pakistan. Polio is still in issue in the Middle East, as well as India and Nigeria. But thanks to the WHO, Unicef and other beneficiaries, polio cases have diminished by 99 percent in the past 20 years. Gates hopes that the efforts will push polio to join smallpox as the only diseases vanquished by vaccines.

2. Andrew Wakefield Fights Back, Exposes British Medical Journal Fraud, Vaccine Funding!

Despite the fact that the link between colon inflammation and MMR vaccination had been published 14 years before Dr. Wakefield's BMJ study, Dr. Wakefield's paper, connecting the GI problems of autistic children and MMR vaccination caused a firestorm.  First Dr. Wakefield's excellent paper was retracted by the British Medical Journal (BMJ) and then Dr. Wakefield was deprived of his license to practice medicine in the UK.

My take as a child and adult psychiatrist and physician?  Those who, like Dr. Wakefield, draw a connection between vaccination and autism, leukemia, neurological dysfunction, diabetes and a host of other problems are totally correct.  My advice?  NEVER vaccinate a pregnant woman.  NEVER vaccinate a baby.  NEVER vaccinate a child.  NEVER vacciante an adolescent.  NEVER vaccinate an adult.  NEVER vaccinate an older person.  ALWAYS vaccinate public health officials and politicians who advocate vaccination.

HOW MUCH ACTUAL BEEF IS IN TACO BELL‘S ’MEAT FILLING’?

MONTGOMERY, Ala. (AP) — An Alabama law firm claims in a lawsuit that Taco Bell is using false advertising when it refers to using “seasoned ground beef” or “seasoned beef” in its products.

The meat mixture sold by Taco Bell restaurants contains binders and extenders and does not meet the minimum requirements set by the U.S. Department of Agriculture to be labeled as “beef,” according to the legal complaint.

The class-action lawsuit was filed Friday in federal court in the Central District of California by the Montgomery law firm Beasley, Allen, Crow, Methvin, Portis & Miles.

Attorney Dee Miles said attorneys had Taco Bell’s “meat mixture” tested and found it contained less that 35 percent beef.

The lawsuit on behalf of Taco Bell customer and California resident Amanda Obney does not seek monetary damages, but asks the court to order Taco Bell to be honest in its advertising.

“We are asking that they stop saying that they are selling beef,” Miles said.

Irvine, Calif.-based Taco Bell spokesman Rob Poetsch (PAYCH) said the company denies that its advertising is misleading.

“Taco Bell prides itself on serving high quality Mexican inspired food with great value. We’re happy that the millions of customers we serve every week agree,” Poetsch said. He said the company would “vigorously defend the suit.”

The lawsuit says that Taco Bell’s “seasoned beef” contains other ingredients, including water, wheat oats, soy lecithin, maltodrextrin, anti-dusting agent and modified corn starch.

Parents, here's another good reason to make sure your kids get enough shut-eye: Children who get sufficient sleep are less likely to be obese, a new study shows.

Other research shows sleep affects kids' academic performance, mood and attention span.

For the latest study, scientists at the University of Chicago and the University of Louisville compared the sleep patterns of 308 children, ages 4-10, with their body mass index, a number that considers height and weight. The children wore special wrist-band devices for a week to track the amount they slept.

Some of the kids had blood work done to look at their glucose, insulin, triglycerides and cholesterol levels, which are markers for the risk of type 2 diabetes and future cardiovascular disease.

The study, out online today in Pediatrics, shows:

*Kids slept an average of eight hours a night. This is far less than the nine or more hours recommended for this age group.

*Kids who slept at least 9 1/2 to 10 hours were the least likely to be obese or to have unhealthy blood work.

*The children who slept the least and had the most irregular sleep schedule (they didn't go to bed at a set time) had a substantially greater risk of being obese and having unhealthy blood work.

*Those who got caught up on sleep on the weekends somewhat reduced their risk of being obese or having unhealthy blood work.

*Obese children were less likely to get caught up on their sleep on the weekends.

"Good sleep routines and sleeping the right amount is the best healthy proposition," says lead author David Gozal, chair of the department of pediatrics at the University of Chicago.

About one-third of children and adolescents in the USA weigh too much, putting them at increased risk for type 2 diabetes, high cholesterol, sleep apnea and other health problems.

Previous research shows that not getting enough sleep may contribute to weight gain partly because it affects hormones that control hunger and feeling full.

It's cancer in a cup: U.S. drinking water is contaminated with a toxic chemical that your own government calls a "probable carcinogen."
So what's that same government doing about it? Same thing it always does: Nothing!

Drink up, everyone.

The chemical is called hexavalent chromium, and if the name sounds a little familiar then you've probably seen the film "Erin Brokovich." It's the toxic compound that set off her battle with Pacific Gas & Electric after it was found in the groundwater of Hinkley, California.
Now, we all may as well be living in Hinkley -- because tests by the Environmental Working Group on water in 35 cities across the country found the chemical in 31 of them.

Twenty-five of those cities had hexavalent chromium levels in excess of limits being proposed by California. And if you're in Norman, Oklahoma, congratulations -- you're drinking 200 times that proposed limit.

We have to go by California's proposed limit because the EPA doesn't have one -- proposed or otherwise.

And that's where this gets really bizarre... because while the EPA doesn't set limits for hexavalent chromium, it does care about total chromium levels.

In other words, it lumps this toxic compound into the same category as the essential mineral trivalent chromium.

One is needed by the body to control blood glucose levels, the other might give you cancer, wreck your kidneys and liver, and maybe even kill you -- but it's all the same to Uncle Sam.

Why sweat the details?

But let's look on the bright side here: Hexavalent chromium probably isn't the worst thing in your water right now.

Heck, it's positively healthy next to the rocket fuel, cocaine, aspartame, hormone drugs, and more regularly found in U.S. drinking water -- and I'm not talking about isolated incidents here.

Everyone knows House Republicans (along with three Democrats) voted Wednesday to repeal Obamacare. But fewer people know what those same House Republicans -- this time, with 14 Democrats -- did Thursday.

By a vote of 253 to 175, the GOP directed key House committees to report on ways to lower health care premiums, allow patients to keep their current health plans, increase access to coverage for those with pre-existing conditions, and decrease the price of medical liability lawsuits. In other words, the committees are beginning work on replacing the House-repealed Obamacare with Republican health policies.

Repeal got a lot of press coverage. Replacement got far less. If they needed any reminding, GOP lawmakers are learning that controlling the levers of power in the House doesn't mean controlling the media narrative on health care. "Democrats wanted to characterize repeal as draconian, ignoring the fact that we do have very, very positive alternatives," says Rep. David Dreier, chairman of the House Rules Committee. "It's been difficult for us to get that [message] out there. We said repeal and replace, and we're in the process of replacing."

House Republicans are pursuing a three-part strategy. Part One was repeal; they promised to do it, and they did it. Part Two is replace, which in coming months will involve House votes on a series of GOP health care measures. And Part Three -- since full repeal can't win in the Senate -- is another series of votes on measures to repeal individual parts of Obamacare. The net result will be that Republicans gradually push more and more House Democrats -- and perhaps some in the Senate -- away from an all-or-nothing defense of Obamacare.

When Democrats passed the national health care bill, many admitted that they didn't like this or that part, or that the bill as a whole wasn't "perfect." But after Obamacare became law, they balked at changing even the smallest part. For example, there is widespread agreement that the so-called 1099 provision -- the requirement that requires businesses to file zillions of new Internal Revenue Service forms -- is extremely burdensome. But when Republicans tried to kill the provision last year, Senate Majority Leader Harry Reid made sure it didn't happen.

Now, after voters gave the GOP control of the House and a stronger voice in the Senate, things are different. Democrats are talking openly about changing Obamacare -- just as long as the changes stop short of full repeal. "Let us modify the health care law in a bipartisan way," House Assistant Minority Leader James Clyburn told Fox News this week. "But this whole stuff of repeal and throwing it out and starting all over -- that's not going to happen."

Obamacare is filled with vulnerable provisions. In addition to the 1099, there's the individual mandate (which is also being challenged in court), cuts to Medicare, and the long-term care measure called the Community Living Assistance Services and Supports Act, better known as the CLASS Act. During the Senate's Obamacare debate in December 2009, some Democrats voiced reservations about each of those provisions.

"Just look at the ones who made noise during the original debate," says a well-connected GOP Senate source. "Claire McCaskill, Ben Nelson, Kent Conrad -- Conrad called the CLASS Act a Ponzi scheme, but he voted for the whole bill that included it. How would he vote on a separate bill to repeal it?"

We'll probably find out. In the next year and a half, Senate Democrats, including some who are facing tough re-election fights in 2012, could have a chance to vote again on the most troublesome parts of Obamacare. With 47 Republican senators, the GOP would need just four Democrats to reach majority support for repealing significant chunks of the health care law.

If that happens, Senate Democrats, who at this very moment are railing against Republican filibusters, would have to resort to -- you guessed it -- a filibuster to stop repeal of any part of Obamacare. Even if they do, Republicans believe they might muster 60 votes to win the day. And if key parts of Obamacare fall, it's not clear whether the whole structure can remain standing.

As those fights go on, House Republicans, with some Democratic help, will pass new measures to address the health care problem piece-by-piece. Some will be attractive to Senate Democrats facing re-election. "A lot of them come from states that are sympathetic to the message we heard last November 2," says David Dreier. "So in light of that, we're not going to give up on this."

Are Americans being deliberately poisoned by the United States Government? As far-fetched as that may sound, evidence is clearly mounting that would indicate that there is an insidious plot underway that threatens the health of every man, woman and child living in America.

In two stories that have floated under the radar for the last couple of years, Congress and health authorities have been working together to pass laws that would sicken the populace and perhaps endanger their very lives.

First, there was the Energy Independence and Security Act, passed by Congress in 2007, a provision of which made it mandatory that the sale of incandescent light bulbs be banned by 2012. These bulbs would be replaced by compact fluorescent light bulbs (CFLs), which are supposed to be more energy-efficient and longer lasting.

In truth, these bulbs contain dangerous amounts of mercury, which, if broken, will pollute the environment, by seeping into groundwater, thereby threatening human health. Phyllis Schlafly, founder of Eagle Forum, recently wrote “The EPA warns that if we break a CFL, we must take the pieces to a recycling center and not launder ‘clothing or bedding because mercury fragments in the clothing may contaminate the machine and/or pollute sewage’.”

Incandescent bulbs contain no toxic chemicals whatsoever.

The new Congress has introduced the Better Use of Light Bulbs Act, or H.R. 91,which would repeal this subsection of the current legislation, allowing Americans to purchase the light bulbs of their choice.

In introducing this bill, Congress took not of a few facts which have not been widely reported:

  • Most CFLs are not manufactured in the United States.
  • the amount of mercury in one bulb is enough to contaminate up to 6,000 gallons of water beyond safe drinking levels.These bulbs need to be disposed of very carefully, and in most cases this means the inconvenience of taking them to a recycling center.
  • Although we are led to believe that the CFL bulbs have a much longer lifespan than traditional incandescent bulbs, they are not designed to be turned on and off frequently. Doing so reduces their lifespan by as much as 85 percent.
  • CFLs can cause skin cancer for people with a sensitivity to light.

In a second, more sinister story, health authorities are now pushing for drugs to be added to the public water supply. These drugs may cause depression and memory loss.

These statins, as they are known, supposedly lower cholesterol and help prevent heart disease and strokes. Health authorities want the drugs added to the water supply, despite the fact that many dangerous side-effects, kept secret by the drug companies have now come to light.

The Cochrane Library, in a newly released study, examined data from 34,000 patients taking these drugs and found that depression, mood swings and short-term memory loss were evident, yet were under-reported or underplayed by the drug companies that funded the research.

Why would health officials and the government want to add toxic drugs which can cause these dangerous side-effects to our water supply?

To control the populace, to keep them docile and easy to manage.

Aldous Huxley, author of Brave New World, in a speech in March of 1962 at Berkeley University, said “there will be, in the next generation or so, a pharmacological method of making people love their servitude, and producing dictatorship without tears, so to speak, producing a kind of painless concentration camp for entire societies, so that people will in fact have their liberties taken away from them, but will rather enjoy it, because they will be distracted from any desire to rebel by propaganda or brainwashing, or brainwashing enhanced by pharmacological methods. And this seems to be the final revolution.”

If this sounds like the stuff of conspiracy theories, remember that recently the government admitted that people are already being mass medicated against their will by sodium fluoride in the water, the health effects of which include lower IQ levels, and increased docility.

It is imperative that Americans wake up to the fact that their government, in a blatant effort to control the masses, will stop at nothing, including the deliberate toxic poisoning of their citizens, to achieve their goals of a society that will acquiesce to the will of the oppressors.

HOUSE APPROVES OBAMACARE REPEAL

In a vote of 245-189, Republicans were victorious in passing a measure to repeal President Obama’s signature health care overhaul law.

The final vote tally includes one no vote — Rep. Gabrielle Giffords, D-Ariz., who continues her recovery.  In addition, three Democrats voted with a solid Republican voting bloc to repeal the law — Ross (AR), McIntyre (NC) and Boren (OK).

The repeal measure now moves to the Senate where is faces a steep uphill battle against a Democratic majority.

The Associated Press has a full re-cap of the day’s debate:

WASHINGTON (AP) — Eager to honor their campaign pledge, Republicans pushed legislation to repeal the nation’s year-old health care law toward House passage Wednesday despite implacable opposition in the Senate and a veto threat from President Barack Obama.

Passage would clear the way for the second phase of the “repeal and replace” promise that victorious Republicans made to the voters last fall. GOP officials said that in the coming months, congressional committees will propose changes to the existing legislation, calling for elimination of a requirement for individuals to purchase coverage, for example, and recommending curbs on medical malpractice lawsuits.

Republicans also intend to try to reverse many of the changes Democrats made to Medicare Advantage, the private alternative to the traditional government-run health care program for seniors.

Like the repeal bill itself, these other measures will require Senate approval and a presidential signature to take effect, and the prospect is for months of maneuvering on the issue.

For many first-term Republican lawmakers, this day was one they had long waited for, a chance to speak and then vote on the House floor against a bill they had campaigned for months to repeal.

Rep. Jeff Duncan, R-S.C. said the legislation produced by Obama and congressional Democrats was a “job-killing, socialistic” approach to health care. Rep. Frank Guinta of New Hampshire, who defeated a Democratic incumbent last fall, said it was misguided, needing repeal.

“The American people have soundly, soundly rejected the Democrats’ government takeover of health care,” said Rep. Sandy Adams of Florida. Rep. Steve Southerland, also of Florida, said the law imposes a crushing tax burden on businesses, and he predicted “1.6 million jobs will be lost by 2014 due to this mandate” to require many businesses to provide coverage for employees. Both Floridians won their seats by turning out Democratic incumbents.

“This is not symbolic. This is why we were sent here,” added Rep. Michelle Bachmann, of Minnesota, a third term conservative with strong support among tea party activists.

On the short end of the vote, Democrats challenged Republican claims and highlighted politically popular elements of the bill that would be wiped out if repeal took effect.

Rep. Jim Moran, D-Va., accused some Republicans of “the height of hypocrisy” by voting to repeal a vast expansion of health care at the same time they had signed up for coverage for their families through a government-organized program available to lawmakers.

Rep. Frank Pallone, D-N.J., said that despite claims of employment loss, the economy had added jobs in each of the past 10 months.

In one of the most animated speeches of two days of debate, Rep. George Miller, D-Calif., said repeal would return power to insurance companies. “Has anybody, any family in America, any single mother, any spouse, any child, any grandparent met a more bureaucratic system than the American health insurance system? There is no more bureaucratic system.”

In the Senate, Majority Leader Harry Reid has said the legislation will not see the light of day there, although Republicans will seek ways to force a vote.

The law faces another challenge, well beyond the reach of Obama’s veto pen. Several lawsuits have been filed, and while some judges have upheld the legislation, one recently ruled it was unconstitutional to require individuals to purchase insurance. The Supreme Court is widely expected to have the final word.

In the meantime, Republicans clearly relished the day.

The Obama administration has made a major effort in recent days to emphasize parts of the bill that have met with public approval, including one that permits children to age 26 to remain on their parents’ policies if they do not have on-the-job coverage of their own. Democrats also argue that repeal would short-circuit other changes yet to take effect, including a ban on the insurance industry’s practice of denying coverage or charging sharply higher premiums on the basis of a pre-existing medical condition.

Republicans intend to address the same issues with legislation they say they will bring to the House floor in the coming months, according to officials who have been involved in discussions on the issue, but no details were immediately available.

Last year, for example, the Republicans proposed a 10-year, $25 billion program to help states fund programs in which high-risk individuals could receive affordable coverage.

GOP leaders are working on the assumption that the repeal legislation will not become law, and they intend to draft future bills as changes to the structure that Obama and Democrats put into place.

On one point, they conceded no change was warranted. Majority Leader Eric Cantor, R-Va., told reporters on Tuesday seniors would be permitted to keep the $250 they have been promised to help defray the cost of drugs under the Medicare prescription benefit.

The legislation Obama signed last year was sweeping in its scope.

The Congressional Budget Office said at the time that when fully enacted, it would spread coverage to tens of millions who now lack it and – in a forecast rejected by Republicans – reduce federal deficits over the next decade.

Beginning in 2014, millions of Americans would be required to carry health insurance, whether through an employer, a government program, or their own purchase. New insurance marketplaces called exchanges would open in each state, enabling individuals and small businesses to pick from menus of private plans that met government standards. Federal subsidies would help defray the costs.

After a heated midterm election, the Republican-led House easily passed legislation to repeal the nation's sweeping health care law.

The vote was 245-189. There were four Democrats that voted for repeal.

Overturning the law was a major campaign plank for Republicans in the 2010 elections, and many of the House's nearly 100 new lawmakers promised to repeal the law that was pushed by President Obama and congressional Democrats.

House Speaker John Boehner said the law would add nearly $1.5 trillion to the deficit and stifle the growth of some small businesses, which are required under the law to provide health insurance to employees or face penalties. A key issue for Republicans is that the law requires all Americans to have health insurance.

"Let's stop payment on this check before it can destroy more jobs and put us in an even deeper hole," Boehner said. "Then let's work together to put in place reforms that lower costs without destroying jobs or bankrupting this government."

Democrats failed in their procedural attempt to send the repeal bill back to committee for a discussion. Meanwhile, House Republicans are already preparing for four House committees to take the next step in the repeal effort and figure out ways to change the law.

Health and Human Services Secretary Kathleen Sebelius reminded Americans that "this vote does not change the law" and that her department will continue to implement its provisions.

Senate Majority Leader Harry Reid, D-Nev., has vowed to block the measure, and Obama has threatened to veto it.

Reid denounced the House's repeal vote as a political stunt.

"This is nothing more than partisan grandstanding at a time when we should be working together to create jobs and strengthen the middle class," he said in a statement today.

Rep. Michele Bachmann, R-Minn., said the House was not engaged in a stunt. "This is not symbolic. This is why we were sent here," said Bachmann, a favorite of the small-government Tea Party movement.

House Majority Leader Eric Cantor, R-Va., challenged Reid and Senate Democrats to show their votes and debate the measure if they are so confident of stopping the repeal effort.

"The American people deserve a full hearing," Cantor said this morning. "They deserve to see this legislation go to the Senate for a full vote."

The only surprise in Wednesday's vote was how many Democrats would support the repeal effort.

In the end, Democrats Dan Boren of Oklahoma, Mike McIntyre of North Carolina and Mike Ross of Arkansas were the only Democrats to join 242 Republicans to vote for the repeal legislation.

One issue key to the repeal debate is how much the law costs and the impact overturning it would have on the deficit. USA TODAY's Kelly Kennedy reports Republicans say the law will add $701 billion to the deficit while Democrats say repealing the measure will cost $230 billion.

Yesterday, Cantor sought to ease concerns from seniors who might think they would have to return $250 they received under the law to help pay for prescription drug costs. Democrats such as Rep. Ed Markey of Massachusetts have said throughout the repeal debate that seniors could be among those affected the most by overturning the law.

Shortly after the law was passed last year, about 2.8 million recipients of Medicare who have a gap in their prescription drug coverage (known as the doughnut hole) received $250 checks to help them defray the cost of medicines.

Asked yesterday whether Republicans would seek to have that money returned, Cantor said no.

"If a repeal bill passes ... the intention is not to require seniors to return the $250 checks they received," Cantor said at his weekly news briefing.

26 States Join Suit Against Obama Health Law

PENSACOLA, Fla. -- Six more states joined a lawsuit in Florida against President Obama's health care overhaul on Tuesday, meaning more than half of the country is challenging the law.

The announcement was made as House members in Washington, led by Republicans, debated whether to repeal the law.

The six additional states, all with Republican attorneys general, joined Florida and 19 others in the legal action, Florida Attorney General Pam Bondi said.

"It sends a strong message that more than half of the states consider the health care law unconstitutional and are willing to fight it in court," she said in a statement.

The states claim the health care law is unconstitutional and violates people's rights by forcing them to buy health insurance by 2014 or face penalties.

Government attorneys have said the states do not have standing to challenge the law and want the case dismissed.

Lawsuits have been filed elsewhere. A federal judge in Virginia ruled in December that the insurance-purchase mandate was unconstitutional, though two other federal judges have upheld the requirement. It's expected the Supreme Court will ultimately have to resolve the issue.

"It is important to note that two of the three courts that have reviewed this law on the merits have found it constitutional, and those decisions --as well as two others the government prevailed on -- are pending in courts of appeal. At the same time, trial courts in additional cases have dismissed numerous challenges on jurisdictional and other grounds that have not been appealed," Justice Department spokeswoman Tracy Schmaler said.

Meanwhile, the White House dismissed an expected vote on repealing the law, saying the Republicans' push was not a serious legislative effort. Democrats have a majority in the Senate and they have said they will block repeal in that chamber.

In the Florida case, the states also argue the federal government is violating the Constitution by forcing a mandate on the states without providing money to pay for it. They say the new law gives the state's the impossible choice of accepting the new costs or forfeiting federal Medicaid funding.

Florida U.S. District Judge Roger Vinson could rule later this month whether he will grant a summary judgment in favor of the states or the Obama administration without a trial.

Florida's former Republican Attorney General Bill McCollum filed the lawsuit just minutes after President Obama signed the 10-year, $938 billion health care bill into law in March. He chose a court in Pensacola, one of Florida's most conservative cities. The nation's most influential small business lobby, the National Federation of Independent Business, also joined the suit.

Joining the coalition in the Florida case were: Iowa, Kansas, Maine, Ohio, Wisconsin and Wyoming.

The other states that are suing are Alabama, Alaska, Arizona, Colorado, Georgia, Indiana, Idaho, Louisiana, Michigan, Mississippi, Nebraska, Nevada, North Dakota, Pennsylvania, South Carolina, South Dakota, Texas, Utah and Washington.

Chuck Norris: Obamacare's Baby Death Panels - Part 2

I finished Part 1 last week informing you that in just a single year, from 2008-09, Planned Parenthood received $363.2 million in government grants and contracts, a $13.6 million increase from the previous year, which resulted in 324,800 abortions.

I then left you to ponder this question, which Sen. Orrin Hatch, R-Utah, asked more than a year ago: "Why should people of conscience be forced to participate in any aspect of abortion?"

That is exactly where Washington is leading us unless this 112th Congress detours from forcing pro-life citizens to pay for abortions via Obamacare or the passing of some legislation like the Freedom of Choice Act.

Thank God the pro-life cavalry has come to Washington. But it needs our help to rally our representatives.

Given that the 112th Congress is the most pro-life Congress in recent history, now is the time to act and stop government subsidies killing innocent unborn life. I'd even challenge tea parties across our country to fight for the unborn as hard as we do for fiscal frugalness and the Constitution.

In our passionate pursuit to cure our economy, are we abandoning those who one day will run it? We must fight equally for freedom fighters within the womb and those outside of it. Abortion isn't health care!

In 1983, President Ronald Reagan issued a proclamation establishing National Sanctity of Human Life Day, which also was issued by Presidents George H.W. Bush and George W. Bush. It is held on the Sunday in January that falls closest to the day (Jan. 22) on which the Roe v. Wade and Doe v. Bolton decisions were handed down by the Supreme Court in 1973.

Comprehensive List of Tax Hikes in Obamacare

Next week, the U.S. House of Representatives will be voting on an historic repeal of the Obamacare law.  While there are many reasons to oppose this flawed government health insurance law, it is important to remember that Obamacare is also one of the largest tax increases in American history.  Below is a comprehensive list of the two dozen new or higher taxes that pay for Obamcare’s expansion of government spending and interference between doctors and patients.

Employer Mandate Tax(Jan 2014):  If an employer does not offer health coverage, and at least one employee qualifies for a health tax credit, the employer must pay an additional non-deductible tax of $2000 for all full-time employees.  This provision applies to all employers with 50 or more employees. If any employee actually receives coverage through the exchange, the penalty on the employer for that employee rises to $3000. If the employer requires a waiting period to enroll in coverage of 30-60 days, there is a $400 tax per employee ($600 if the period is 60 days or longer).

Combined score of individual and employer mandate tax penalty: $65 billion/10 years

Surtax on Investment Income ($123 billion/Jan. 2013):  This increase involves the creation of a new, 3.8 percent surtax on investment income earned in households making at least $250,000 ($200,000 single).  This would result in the following top tax rates on investment income

Other unearned income includes (for surtax purposes) gross income from interest, annuities, royalties, net rents, and passive income in partnerships and Subchapter-S corporations.  It does not include municipal bond interest or life insurance proceeds, since those do not add to gross income.  It does not include active trade or business income, fair market value sales of ownership in pass-through entities, or distributions from retirement plans.  The 3.8% surtax does not apply to non-resident aliens.

Excise Tax on Comprehensive Health Insurance Plans($32 bil/Jan 2018): Starting in 2018, new 40 percent excise tax on “Cadillac” health insurance plans ($10,200 single/$27,500 family). For early retirees and high-risk professions exists a higher threshold ($11,500 single/$29,450 family).  CPI +1 percentage point indexed.

Medicine Cabinet Tax($5 bil/Jan 2011): Americans no longer able to use health savings account (HSA), flexible spending account (FSA), or health reimbursement (HRA) pre-tax dollars to purchase non-prescription, over-the-counter medicines (except insulin)

HSA Withdrawal Tax Hike($1.4 bil/Jan 2011): Increases additional tax on non-medical early withdrawals from an HSA from 10 to 20 percent, disadvantaging them relative to IRAs and other tax-advantaged accounts, which remain at 10 percent.

Flexible Spending Account Cap – aka“Special Needs Kids Tax”($13 bil/Jan 2013): Imposes cap of $2500 (Indexed to inflation after 2013) on FSAs (now unlimited). . There is one group of FSA owners for whom this new cap will be particularly cruel and onerous: parents of special needs children.  There are thousands of families with special needs children in the United States, and many of them use FSAs to pay for special needs education.  Tuition rates at one leading school that teaches special needs children in Washington, D.C. (National Child Research Center) can easily exceed $14,000 per year. Under tax rules, FSA dollars can be used to pay for this type of special needs education.

Tax on Medical Device Manufacturers($20 bil/Jan 2013): Medical device manufacturers employ 360,000 people in 6000 plants across the country. This law imposes a new 2.3% excise tax.  Exemptions include items retailing for less than $100.

Raise "Haircut" for Medical Itemized Deduction from 7.5% to 10% of AGI($15.2 bil/Jan 2013): Currently, those facing high medical expenses are allowed a deduction for medical expenses to the extent that those expenses exceed 7.5 percent of adjusted gross income (AGI).  The new provision imposes a threshold of 10 percent of AGI; it is waived for 65+ taxpayers in 2013-2016 only.

Tax on Indoor Tanning Services( $2.7 billion/July 1, 2010): New 10 percent excise tax on Americans using indoor tanning salons

Elimination of tax deduction for employer-provided retirement Rx drug coverage in coordination with Medicare Part D($4.5 bil/Jan 2013)

Blue Cross/Blue Shield Tax Hike ($0.4 bil/Jan 2010): The special tax deduction in current law for Blue Cross/Blue Shield companies would only be allowed if 85 percent or more of premium revenues are spent on clinical services

Excise Tax on Charitable Hospitals (Min$/immediate): $50,000 per hospital if they fail to meet new "community health assessment needs," "financial assistance," and "billing and collection" rules set by HHS

Tax on Innovator Drug Companies($22.2 bil/Jan 2010): $2.3 billion annual tax on the industry imposed relative to share of sales made that year.

Tax on Health Insurers($60.1 bil/Jan 2014): Annual tax on the industry imposed relative to health insurance premiums collected that year. The stipulation phases in gradually until 2018, and is fully-imposed on firms with $50 million in profits.

$500,000 Annual Executive Compensation Limit for Health Insurance Executives($0.6 bil/Jan 2013)

Employer Reporting of Insurance on W-2(Min$/Jan 2011): Preamble to taxing health benefits on individual tax returns.

Corporate 1099-MISC Information Reporting ($17.1 bil/Jan 2012): Requires businesses to send 1099-MISC information tax forms to corporations (currently limited to individuals), a huge compliance burden for small employers

“Black liquor” tax hike(Tax hike of $23.6 billion).  This is a tax increase on a type of bio-fuel.

Codification of the “economic substance doctrine”(Tax hike of $4.5 billion).  This provision allows the IRS to disallow completely-legal tax deductions and other legal tax-minimizing plans just because the IRS deems that the action lacks “substance” and is merely intended to reduce taxes owed.

BREAKING: 5 States Consider JAIL Time for Feds Enforcing Obamacare

This is just a quick update on the Federal Health Care Nullification Act (read about it here: http://su.pr/9HQlxY) - first introduced in Texas, and now also introduced in Maine, Montana, Oregon and Wyoming.  For example:

Any official, agent, employee or public servant of the state of Wyoming as defined in W.S. 6-5-101, who enforces or attempts to enforce an act, order, law, statute, rule or regulation of the government of the United States in violation of this article shall be guilty of a felony punishable by a fine of not more than five thousand dollars ($5,000.00), imprisonment in the  county jail for not more than two (2) years, or both.

Sources close to TAC tell us to expect at least 10 states consider this bill in 2011.

HHS Recommends Lower Fluoride Levels in Drinking Water

This is news that normally would find those in the know jumping up and down for joy.  But as we are living in times where you constantly need to be questioning everything and always watching the other hand, we need to be asking ourselves why?!?

January 10, 2011 - The U.S. Department of Health and Human Services announced a federal proposal to reduce the recommended level of fluoride in drinking water to prevent a discoloration and pitting of the teeth known as dental fluorosis. The proposal is based in part on EPA assessments that were prompted by a 2006 National Research Council report, which recommended that EPA reconsider its fluoride standards to take into account health effects such as dental fluorosis and consider all sources, including toothpaste and mouthwash, of fluoride exposure.

Elevated fat and cholesterol levels -- common in the Western diet -- may increase the risk of breast cancer, U.S. researchers suggest.

Biologist Philippe G. Frank of Thomas Jefferson University says the incidence rate of breast cancer is five times higher in Western countries than in other developed countries.

The researchers used the PyMT mouse model believed to closely parallel the pathogenesis of human breast cancer. The PyMT mice were placed on a diet that contained 21.2 percent fat and 0.2 percent cholesterol, reflective of a typical Western diet, while a control group of PyMT mice received food containing 4.5 percent fat and negligible amounts of cholesterol.

The study published in The American Journal of Pathology found tumors began to develop quickly in mice fed the fat/cholesterol-enriched chow, the number of tumors almost doubled and they were 50 percent larger than those observed in mice that ate a normal diet.

"The consumption of a Western diet resulted in accelerated tumor onset and increased tumor incidences, multiplicity, and burden, suggesting an important role for dietary cholesterol in tumor formation," Frank says in a statement.

In addition, there was also a trend toward an increased number of lung metastasis -- cancer spread -- in mice fed the fatty diet, Franks adds.

SCHOOL AGREES TO ALLOW SERVICE DOG TO ACCOMPANY EPILEPTIC 12-YEAR-OLD

AndrewSuffering from a rare and severe form of epilepsy, 12-year-old Andrew Stevens can experience up to 20 seizures a day, any one of them potentially fatal. But thanks to a German shepherd service dog named Alaya, Andrew doesn‘t have to be under his parents’ watchful eye at all times. He can now go out and play, walk his dog down the street and use the bathroom unaided.

But Andrew’s freedom ended at his Virginia schoolhouse doors as the Fairfax County Public School system barred him from bringing Alaya to school with him. “I think what they’ve done has really been an injustice to my son,” Nancy Stevens, Andrew’s mother, told Matt Lauer on NBC’s “Today” show Tuesday. “A service dog is trained very well. If Andrew sits, the dog is going to sit. If Andrew gets up, the dog is going to get up. A service dog will not bite anybody at all,” she said, addressing the school’s safety concerns.

But after drawing national attention and public outcry from across the country, Change.org reported Tuesday evening that its campaign on Andrew‘s behalf had successfully forced Andrew’s school district to alter their stance.  “It’s time to celebrate a victory for disability rights, epilepsy awareness and a boy and his dog!” the site said, announcing its members had flooded Andrew’s school administrators with 371 emails in protest of the ban. Today, Ft. Belvoir Elementary officials told Andrew’s parents that Andrew could bring Alaya to school with him as early as next week. In the beginning, Angelo and Nancy will accompany Andrew to school, riding the bus with him and staying with him and Alaya during the day. As teachers and students adapt and learn how to interact with Alaya, Andrew’s parents will gradually transition away and Andrew and Alaya will go to school together — as originally planned.

Not only that — the school is now looking at updating their policy on disability access, Angelo Stevens told Change.org today. This all comes thanks to the grueling work done by Andrew’s parents to advocate for their 12-year-old son and his service dog.

The Stevens family created a foundation in Andrew’s name, first to raise money for Alaya, and now to raise money for service dogs for other needy children. That foundation, and the TODAY show coverage, has meant that he‘s been contacted by other parents around the country who are trying to get their childrens’ service dogs admitted in schools.
